My mother, the witness

Been doing shittons of research and lawyering in the past week and a half, including filing craptons of stuff in the one case I'm working. I love research and I love preparing and figuring out details to be discussed in hearings, but let's be real: the Rules of Civil Procedure, service requirements, and deadlines (or, in reality, the fact that I might fuck them up entirely) terrify me, y'all.


That's why it was nice reading my mother's deposition for a case in which she's currently a party--it made me feel a little more competent as an attorney. Two particular gems from the depo, which involve litigation arising from her being hit from behind while at a stop light:

(Q) When was the first time you saw this truck?
(A) When it hit me.

And let's not forget this one, which tickled my funny bone and for which my mother didn't even offer up an answer, although I can imagine VERY CLEARLY the expression on her face:

(Q) When is the first time you became aware of this accident?

Wait, WHAT?

I get it from somewhere. Clearly.

Demons in Detroit

I haven't been able to do my usual ghostly exploring lately. Real life has made me way to busy for the dead, but I have been able to do a lot of reading.  My latest read, Ghost of Southeast Michigan by Kristy Robinett, has been wonderful  fun.  I will tell one of my favorite stories from this book here and if you want to find the rest you'll have to check the book out yourself.

This story was called Demons in Detroit.  It is a simple tale that sounds almost too much like something from a horror movie, but the author investigated this case herself and claims it is real.  It is set in a lovely house on Cherry Hill across from Mount Kelly Cemetery.  According to the author, she met Mark and Connie at their lovely home outside of Detroit. The two had bought the house recently and loved it and didn't want to move.  However, since they moved into the house, they had felt an evil presence tormenting them.  At first, the presence revealed itself subtly.  Connie couldn't sleep.  She felt things push her or brush past her.  The couple had terrible nightmares.   But things quickly escalated,  all the knives in their drawers vanished, and Mark found them buried upside down in the backyard.  Other items would relocate.   Finally,  the couple decided to purchase some crosses to hang about the house to bless it.  The crosses always fell down.  The other pictures would stay up, but the crosses fell down.  One time when Connie was walking down the stairs,  something hot pushed her and left a burn mark on her arm.   Finally, the desperate couple called a priest to bless the house.  The priest walked through the house doing the blessing and when he left, he told the couple that something evil was in the house with them and they should leave.

The author says that the couple were finally able to free their home of the demon with the aid of a priest and a demonologist.  They still live there and have had a baby girl since then.

Welcome to the big girl world....

Last week I mentioned sending my letter to opposing counsel. I can only imagine what he did when he received it, but I don't think him shitting on it and setting it on fire are outside of the realm of possibility. 

I say this because this week, my client was served with motions regarding her case, after he knew I was her attorney. For you non-attorneys out there, let me explain: that doesn't go against figurative ethical protocol. It goes against ACTUAL WRITTEN FUCKING RULES. Specifically, one regarding contacting a person that they know to be represented by counsel. I was pissed, but I let it slide. 

Even though I wanted to smack a bitch. 
He also filed a piece of shit motion that was passed ex parte. And, again, for you non-legal scholars, ex parte doesn't mean a party where all your exes are in attendance (although given the circumstances--custody, I find  the name ironic)-- it simply means my client didn't receive notice of the proceedings. 

I may have done some of this when I got wind of this shit. 
But today. TODAY. While arranging a hearing with him on the phone during a conference call with a judicial assistant, I happened to ask if he had gotten the letter of confirmation regarding another hearing we have together. His response: I'm sure my girls got it. 

To which I replied "That's funny, because I called your office yesterday and "your girl" told me you were the only one who had access to that email account. So....is there a secondary address I can send this next confirmation to in order to assure you get it?" 

Come at me, bro bitch. 

Sometimes, it's the little things. 

Mixed Bag

A bit of a mixed bag for this post...

If you read my vilification of modern technology from last time you wouldn't believe I was an electronics engineer for thirty years, working on wide ranging projects from automotive engine management to fibre optic communications. Maybe I was in the wrong job all that time. Maybe I was just a terrible engineer.

It's not that I don't believe in progress it's just that we seem to have become dependent, even addicted, to our state-of-the-art gadgets and when they go wrong it screws up our lives completely. I resisted owning a mobile phone until I became an exam invigilator and sometimes found myself in need of support but unable to leave the classroom. When a colleague recently asked me to text her if I needed help I had to inform her that I didn't know how to perform such a task. I'll never forget the pitying look she gave me. I wasn't even sure if my cheap Tesco phone had that facility. I've since been assured that it does.

Other news:

I had a story in The Weekly News in June and another one appeared this week. People's Friend featured one of mine last week and I still have another one due in Take a Break Fiction Feast soon. Then there is the one for Yours magazine Yearbook due in a few months.

My friend Carol won Nottingham Writers' Spring short story comp which was judged by another fellow blogger Patsy Collins. I'm looking forward to reading Carol's winner in our quarterly magazine Scribe. My own effort came third.

I'm currently trying to keep up my work rate with the added distractions of Test Cricket and the Tour de France. I hope you are all managing to keep cool and carry on writing.

Super Exciting......

Today, aside from studying, I did something super exciting. I edited a letter that's been sitting in my documents folder for twenty days. I cleaned it up, and printed it out on nice, cream-colored linen paper. I printed a matching envelope out with my address on it. And after my name, I put "Attorney at Law."

Because today I mailed a letter to opposing counsel on behalf of my very first (albeit pro bono) client. I was nice. I was cordial. I was fair. But I was also firm. And I feel awesome. 

Let's not mention the fact that this is the very first time I'm practicing law on someone without any supervision. Or the fact that I am terrified of committing some sort of terrible instance of malpractice. Or the fact that SOMEONE'S LEGAL EXISTENCE IS IN MY HANDS.

Nope, I'm going to focus on the fact that until this letter hits and I get a response, I am the head motherfucker in charge. Then, we'll just have to see how it plays out. Besides, my client knows she's the first person I've represented...

Characteristics of a "Financially" Virtuous Woman

Do you (or someone you know) want to be a "Financially" Virtuous Woman? I DO!
   
I've seen many articles about the characteristics of the Proverbs “Virtuous Woman.”  But, I haven't really found too many about how to be a "Financially" Virtuous Woman.  I not only strive to be a Proverbs Virtuous Woman, but I also strive to be a "Financially" Virtuous Woman as well.    
 
So, here are my interpretations of the Characteristics of a "Financially" Virtuous Woman based on Proverbs 31:10-31 (KJV). 
 
She knows her value.
10 Who can find a virtuous woman? for her price is far above rubies.”
 
Like an authentic and priceless gem, she knows her value and doesn't settle. When a woman knows her value to an organization that she is working for, she will not settle for low pay or abusive working conditions. She knows that she is worth more and deserves better.
  
She is trusted by her spouse (or God).
11 The heart of her husband doth safely trust in her, so that he shall have no need of spoil. 12 She will do him good and not evil all the days of her life.
 
She protects the financial security of her family and is fiscally responsible. She only has the best intentions and helps to reach her family's financial goals. Therefore, her spouse “safely” trusts her and in her personal financial management. If she is single, she is trusted by God.
 
She will work to provide for her household.
13 She seeketh wool, and flax, and worketh willingly with her hands. 14 She is like the merchants' ships; she bringeth her food from afar. 15  She riseth also while it is yet night, and giveth meat to her household, and a portion to her maidens.”
 
Whether it is going to work or getting another job, she will do whatever it takes to financially provide for her family, when and if necessary.
 
She is a homeowner or owns real estate.
16 She considereth a field, and buyeth it: with the fruit of her hands she planteth a vineyard.”
 
She owns or has owned real estate as a homeowner or as an investor. This not only shows that she is financially self-sufficient, but it also shows that she is responsible with her finances and credit to be able to qualify and afford real estate.
    
She is fit.
17 She girdeth her loins with strength, and strengtheneth her arms.”
 
She is not only physically fit with strength to handle the demands and responsibilities placed upon her; she financially fit with the strength of personal financial knowledge to handle or assist with the financial demands and responsibilities of the household.
 
She is disciplined.
18  She perceiveth that her merchandise is good: her candle goeth not out by night. 19 She layeth her hands to the spindle, and her hands hold the distaff.
 
Even when she doesn't feel like it or want to do it, she is disciplined enough to do what is necessary to do whatever needs to be done for the betterment of herself and her family.

Whether it is at church, for a non-profit organization, or in her community; she gives her money, resources and time to help others who are less fortunate than she is. She understands that the Power of Prosperity lies in her Gift of Giving.

She is loved and adored by her children and her husband and they appreciate everything she does to protect, defend, support and take care of the family. They know that the love she has for her family is her driving force to do what she does, only the way she can do it for them.

29 Many daughters have done virtuously, but thou excellest them all.”
 
She is driven to do her best. She may not be competing with others. Rather, she is usually competing against herself with a goal to be financially better off than she was a month or year before. She reads books and seeks information and assistance to improve her personal financial management skills.

She is humble & loves the Lord.
30 Favour is deceitful, and beauty is vain: but a woman that feareth the Lord, she shall be praised.”
 
Although she is beautiful and has nice things, she remains humble and does not boast. She also has a relationship with God and understands that all that she has is a gift from God. She tithes because she believes that "You can't beat God's Giving!"

She is a Role Model.
31 Give her of the fruit of her hands; and let her own works praise her in the gates.”
 
She is admired by others by the way she carries herself in public and at home. She doesn't take this responsibility lightly and understands her impact on her family and her community. Her financial success and freedom are her fruit she bears and shares.

Pasig River Monster

I've been searching for stories and/or legends about Pasig River, but I found nothing. When I open my E-mail account, I stumbled upon a message of a contributor, and luckily the story she sent was about Pasig River Monster.

As brief introduction to the Pasig river, it is a river in the Philippines that connects Laguna de Bay to Manila Bay. Stretching for 25 kilometres (15.5 mi), it is lined by Metro Manila on each side. Its major tributaries are the Marikina River and San Juan River.

Syokoy Caught in Pasig River

This story was told by my mother every time I asked her to tell creepy stories whenever I and my sister feel so. I know that this is true and thus I believe in them--- these creatures.

My mother said it was around November 1981. She was then pregnant to my eldest brother that time and they lived in San Joaquin Pasig (Pasig is a city now). One of their neighbor told the other neighbor that there was someone caught from the river. Because of curiosity, my mother along with her husband and their neighbors rushed to the Municipal Hall. When they get there, my mother's husband forewarned my mother not to look because she might "paglihian" whatever she might saw. But my mother insisted. There were many people inside the municipal hall which were also curious about the creature. They forced inside the hall. Then, about 2 feet away from the jail, my mother had a glimpse from the creature. She described it as a little child about 10 years old with green skin. It's a slight of blacky, maybe because the creature was out of the water for several hours. It has full big black eyes like it wore goggles. The creature just stand there inside the jail with it's hands holding the metal bars. My mother said the creature was scared, shocked and also wondering of many people surrounding him. After that, my mother's husband insisted to go home and so they do go home.

The next day, the neighbors told my mother that the creature was gone. They also wanted to see the creature. But the police officer told them that the creature was taken by someone saying that it was their child. There are other stories that it was thrown back to the river by the order of the mayor in afraid that something might happen to them if they still keep it around. It was published in the newspapers but were also vanished quickly in the light.

I searched google to find something about it but there was none.


As she described the monster caught in the river, one thing rose in my mind - a kappa.

Kappa [left] (or sometimes called Kawataro meaning river-boy), in Japanese folklore, was a humanoid, resembling a little child, and with scaly and reptilian-skinned (just like that of a turtle) monster. Their skin is usually color green, and sometimes yellow. Like the monster above, this creature also live in rivers.

While Siyokoys are mermen, sea creatures that have a human form and scaled bodies. The Siyokoy is the male counterpart of the Sirena. It is usually depicted with green scaly skin, ears resembling fish fins, having fishtail or scaled legs, and webbed feet. They could also have long, green tentacles. They drown mortals for food. They could have gill slits colored brown or green.

Although both would look like the same in imagination, what made me think it was a kappa is . . . She described it as a little child about 10 years old with green skin. That's her description.

By the way, before I end this discussion, the author also wanted to know if someone knows the same story as hers. She would also like to know it like me.

I have ten days before I'm sitting in a Prometric Site well on my way to failing the patent bar exam.

Most people think I'm exaggerating when I say this. Let me be clear: I'm not. And, just to back up this assertion, I'm going to give you a short list of reasons why I'm almost* undoubtedly going to fail the bar exam.

*I say almost because there's the slim possibility the baby Lord Jesus may swoop down from Heaven and grant me the infinite wisdom of the MPEP and I might somehow, with his divine guidance, make the required 70% to pass the test. But....I'm not going to bank on it. 

1) I've not studied enough. I've probably put in about 100 hours of study time. Maybe 80 hours, if I'm being super honest with myself. I have been pulled in all different directions, and allowed myself to be entirely too ADHD with my studying process, which means that these 80-100 hours of studying have been non-linear and a clusterfuck of confusion. Most people study, at minimum, 250 hours for this exam.

2) This bar exam is different. I've taken and passed two bar exams. And this exam is different because (a) it's open book, (b) it has no essays, and (c) it's not scaled, this just means that bar examining committee has more leeway to ask hypertechnical questions, and that I can't rely on dumbasses who do worse than me to pull my score up. It's either pass or fail. No in-between. And to pass, you have to study a shitton of hours. (See #1)

3) New material has made this bar exam almost impossible to study for. In 2011, Obama signed into law the America Invents Act, which took our patent system from a first to invent to a first to file process. The bar exam started testing this in full effect three months ago. This means that I have to be responsible for all the material before the America Invents Act (AIA) and ALLLLL the information after as well. This means twice the friggin material, and no real guide as to how these questions are going to be framed and no really good way to study for them.

Exactly. 
Now, I can go on and on about exactly how fucked I am, but this blog entry is a testament to EVERYTHING I'M DOING WRONG. I'm sitting here bitching about this exam that I'm going to fail rather than praying to the baby Lord Jesus or lighting a candle in his honor or, you know, actually studying for the motherfucking patent bar exam.

So yeah, maybe YOU can light a candle for me? Or pray that Jesus rides in on his pterodactyl and saves the day. Because otherwise, well, I'm fucked.

10 Tips for Eliminating Depression

Sing along
Sing along to make your brain will be calm and to improve mood and alpha brain waves. Women who include music in their daily lives or sing for 10-15 minutes per day is known to recover from depression to 55% and reduce the risk of depression by 50%.
Eating avocados
Research shows, eat half an avocado every day can reduce the risk of depression and its symptoms by 25%. This is because the avocado will be full of monounsaturated fatty acids, a nutrient that can encourage the brain to produce the hormone dopamine, known as the love hormone causes a feeling of calm and comfortable.
Include starch in the diet
Starch is a refined flour in sediments yams, cassava, potatoes, and so on are shredded. Potatoes are known to increase the level of tryptophan in the brain as much as 54%.
Join the club of physical activity

6 Strategies to Pay for College Without Going Broke

We have watched the news and the trends of how student loan debt continues to surpass consumer debt, cost of tuition continues to rise, scholarship funding is more competitive and state incentive aid such as HOPE scholarships are no longer options that yield hope.  So, what is a parent to do?  This information is to help you think outside of the normal paradigm and look at strategies that can bring about viable college options.  We encourage you to have an open mind about your options and focus on making smart decisions not costly decisions.  It’s all about the end goal, and that is a competitive college education at the lowest cost possible.
   
The goal is to equip you with tools that will keep you from making the same mistakes many parents make. This is the only way we can change the landscape for our future generation. So, I hope you are ready to learn and take action based on what you’ve learned. Our mission is for you to obtain the maximum amount of money possible for child applies.
  
Strategy #1: Send Your Child To A Community College For His/Her First Two Years Of School. If your child works hard and gets good grades, they can usually transfer to a top private university. This way, they can get a diploma from a prestigious school for half the cost!
 
Strategy #2: Pick Colleges focused on Minimizing Student Loan Debt. The Project on Student Debt is an initiative of the Institute for College Access & Success, a nonprofit independent research and policy organization dedicated to making college more available and affordable to people of all backgrounds.  As a result, the colleges on their approved list have developed financial aid policies that limit or eliminate student loans from financial aid packages, reducing costs for students and families.
 
You also have National Association of System Heads (NASH) Access to Success Initiative project with The Education Trust. A2S works with 22 public higher education systems that have pledged to cut the college-going and graduation gaps for low-income and minority students in half by 2015. Together, these institutions serve more than 3.5 million students. They Meet 100 percent of their admitted full-time undergraduate students’ financial need for fall 2010. That means the average gaps between a school’s total cost of attendance—tuition, fees, room and board, books, travel, and other expenses—and every student’s EFC – Expected Financial Contribution was filled with some combination of aid.
 
Getting accepted into any of the schools on this list will almost guarantee your child will graduate with little to no student loan debt.  But please know that your child must be competitive and yet again, produce good grades and high test scores.
  
Strategy #3: Understand and Maximize the FAFSA Form.  By understanding the formula, you will start to see how different factors will affect your eligibility for financial aid. For example, “Should you move the assets out of your child’s name?” or “Should Mom or Dad take two courses at a local community college to qualify as a part-time student?” By knowing the formula in advance of applying, you can legally set up your personal and financial situation to maximize your eligibility for financial aid. Your bottom line goal is to minimize your EFC – this is what the government feel you can afford to contribute.
  
File Your Financial Aid Forms Accurately And On Time. Remember, financial aid is awarded on a first come, first served basis. 66% of the forms submitted have an error on it. If you submit your forms with errors or omissions, it will probably “bump” the financial aid forms, and you will have to resubmit them at a later time. If this happens, you will probably lose aid since they award money on a first come, first served basis. Most schools have different deadlines, and if you miss their deadline, you will almost definitely get less funding.
     
Strategy #4: Pick Colleges That Have The Best Histories Of Giving Good Financial Aid Packages. Many schools publish statistics on how much “need” they meet and how much FREE money and loans they give out. Know these numbers before you apply, so you don’t waste time and money applying to schools you’ll never be able to afford. If they offer loans, determine how many subsidized vs. unsubsidized loans are awarded. When loans become part of the equation, do your best to qualify for federally subsidized loans, which are interest-free and principal free until your child graduates.
  
If you still need to borrow more money, try borrowing from your 401k plan or a pension plan. Many plans will allow you to borrow up to 50% of the value of the plan or up to $50,000 interest-free. You can also think about refinancing your current mortgage (not a home equity loan) because long-term rates are typically low during these times, much lower than student loan rates and, under most circumstances, tax deductible (but consult your tax advisor, of course.)
  
Strategy #5: Don’t Be Afraid To Negotiate For A Better Financial Aid Package. Always Apply To, At Least, Two Or Three Schools That Are Rated Equally. This way, if your child gets accepted to all of them, you may be able to play one against the other when negotiating to get a better financial aid package.
 
A school’s financial aid package is NOT fixed in stone. Just because they offer you a certain package, doesn’t mean you have to accept it. If you know how to calculate your “expected family contribution” and you find out what the school’s history of giving out financial aid is, you can usually get a pretty accurate idea of what you should have received. If the school’s offer is way off – write a letter to negotiate. I have seen many cases where schools gave $2,000… $3,000… even $6,000 more than they originally offered just because the family asked. The moral is – Don’t Be Afraid To Negotiate!
  
Strategy #6: Have Your Child Enroll In Advanced Placement Classes And College Level Courses While Still In High School. Every college level course they place out of is money you won’t have to pay when they go to college. Considering college credits can cost as much as $300 each, having your child place out of these courses can save you a lot of money. This happens when AP classes are successfully completed and the subject tests passed when taken in May. By taking foundational core classes at a local college/university while in high school, will decrease the amount of classes a student take once enrolled on a full-time basis, could be covered through a high school – university collaborative and it proves to admission representatives your child is college ready.
  
There are many more strategies for you to implement. Hopefully, these 6 strategies will motivate you to get started and take action in looking at how to create a plan of action that will facilitate your child’s dream and future so they can achieve college success.

New Cover Art: The Monster Hunter's Manual

The Monster Hunter's Manual is the story of Gabriel.  Gabriel is a boy who has just lost everything.  His parents have died and he's forced to move to a strange county, France, to find a new home.  He dislikes his crazy aunt, who he has to live with, he doesn't want to learn French, and to make matters worse, the only real family he has left is his whinny, baby brother.  Despite all this, as soon as Gabriel enters his aunt's ancient castle, he realizes that all these disasters might be the beginning of a grand adventure.  In the castle of Chateau Larcher, the walls groan and the attic talks.  Shadows take on strange shapes and Gabriel becomes convinced the castle is haunted.  But the ghosts in Chateau Larcher aren't what Gabriel expects and he soon learns that skeletons aren't always scary and ghosts can tell the most interesting stories.  Even Aunt Perrine can end up being the most powerful monster hunter in the world.

5 Car Buying Tips for Women

Do you (or someone you know) want to avoid paying more than you have to when buying a car? I do!

If you are in the market for a new car now or in the near future, here are 5 Car Buying Tips to help save money when shopping for your next car.
   
KNOW YOUR BUDGET
The first and most important tip is to know "How much you can afford!" Do NOT let a car dealer's finance department or bank tell you how much you can afford.  Both essentially want to ensure that you borrow as much as possible so they can make more money off of you. The more they can make you believe that you can afford, the more the car dealership will make on the car and the more loan interest income the bank will earn on your loan.
   
GET PRE-QUALIFIED
The best way to avoid unpleasant surprises; like, not qualifying for the amount wanted, needing a cosigner or getting a ridiculously high interest rate, is to get Pre-Qualified or Pre-Approved for an auto loan. Go to your bank or credit union to apply for the auto loan. Tell them the payment amount you can afford to pay so they can determine the total loan amount based on the interest rate and term you qualify for based on your credit. Remember, the Higher your Credit Score, the Lower your interest rate and the More loan amount you will qualify for.  Adversely, the Lower your Credit Score, the Higher your interest rate and the Less loan amount you may qualify for or a down payment will be required.
    
RESEARCH BEFORE YOU CAR SHOP
Now it's time to have some fun going online to search for a vehicle in your price range. Dealers with No Haggle Deals are really good because they usually sell their vehicles below NADA or KBB value.  Next go to NADA or KBB website to find out and print the Trade In and Retail Values to take when you go shopping.
    
TAKE A MAN WITH YOU
Take your husband, boyfriend, father, brother, uncle, male coworker or that dude from down the street. Even if he knows nothing about cars or negotiating, take a man with you when you go car shopping. If the sales person begins speaking directly to the man, play along and coach your escort in what to say or not say. You are in control of the transaction; he is just the figure head.  Unfortunately, women are sometimes taken advantage of during the car sales process.
     
NEGOTIATE BEFORE THE TEST DRIVE
Sometimes we absolutely lose our mind after we get intoxicated by that "New Car" smell during the test drive. My advice is to negotiate before you test drive to have a clear mind during the negotiation process.
    
Here are a few things to do when you get to the car dealer: 

  1. Tell the sales person that you are doing a cash purchase. (Because you have already been pre-approved!) 
  2. Do NOT give your personal information or allow them to run your credit. (Again, you are already pre-approved.) 
  3. Tell the sales person what type of car and the price you are looking for. 
  4. Ask if the car has any rebates or if the dealership has any incentives
  5. Ask to see the buyers order with options to see the breakdown of all expenses and fees to help you with negotiating. 


Use your NADA or KBB value to negotiate the price as close to the Trade In value as possible. Negotiating the price as close to the Trade In value will give you equity in your car, as well as help you when you decide to trade in the car later.
     
You may not be able to get the car of your dreams today, but by getting a reasonably priced vehicle within your budget, you will be able to save money and get that dream car in your near future. Happy Shopping!
